These terms and conditions will apply when you access our website. Before proceeding to subscribe and use our website, we ask that you read these terms and conditions carefully. This site is owned and operated by Diary UK Limited (“Diary UK Ltd”, “we” or “us”) which has its registered office at 22 Chatham Close, Seaton Delaval, Tyne & Wear NE25 0PB. Registered number 05079608 (England and Wales). You (or “the customer”, “member” or “subscriber”) means the Party making use of the web site or sites and services provided therein owned and operated by Diary UK Limited including, but not restricted to, www.internetdiary.net and www.online-diary.co.uk.
- Damage to your Computer
Diary UK makes every effort to ensure that this website is free from viruses or defects. However, we cannot guarantee that your use of this website or any websites accessible through it won’t cause damage to your computer. It is your responsibility to ensure that the right equipment is available to use the website and screen out anything that may damage it. Diary UK Ltd shall not be liable to any person for any loss or damage which may arise to computer equipment as a result of using this website.
- Consequential Loss
Diary UK Ltd shall not be liable for any consequential loss suffered by the customer as a result of using the website or by any act or omission or commission by Diary UK Limited, its staff or its agents. In all circumstances, Diary UK Limited’s liability shall be limited to the subscription fee paid by the customer .
- Password Security
You are responsible for maintaining the confidentiality of your username and password. Diary UK Ltd shall not be liable to any person for any loss or damage which may arise as a result of any failure by you to protect your username and password. Furthermore, you are responsible for all activities that occur in your account and you agree to notify us immediately of any unauthorised use of your account. Diary UK Ltd is not responsible for any loss that you may incur as a result of any unauthorised person using your account or your password.
- Links to Other Websites
You may not link this website to any other website without prior permission. Furthermore, we do not make any warranties, representations or undertakings about the content of any other website which may be referred to or accessed by hypertext link with this website, and we do not endorse or approve the content of such third party websites. However, in order to make your subscription payments which allow you to become a subscriber to our website, you will be linked to the website of World Pay at http://www.worldpay.com, which is responsible for processing your payment details to effect the subscription. By accepting these Terms and Conditions, you accept and acknowledge that the terms and conditions governing the processing of your payment and subscription details shall be those appearing on the World Pay website.
- Exclusions of Liability
Any disclaimers and exclusions of liability in these Terms & Conditions shall not apply to any damages arising from death or personal injury caused by the negligence of Diary UK Ltd or any of its employees or agents or fraud. These disclaimers and exclusions shall be governed by and construed in accordance with the law of England and Wales. If any provisions of these disclaimers and exclusions shall be unlawful, void or for any reason unenforceable then that provision shall be deemed severable and shall not affect the validity and enforceability of the remaining provisions.
Diary UK Ltd reserves the right, at its sole discretion, to terminate your access to the services or any portion thereof at any time, without notice. Diary UK Ltd may terminate or suspend your access to this site for failing to make the required annual subscription payment. We will send you a reminder via e-mail 30 days before the payment is due. If the payment is not received by the end of your annual subscription period, we will send a further email reminder and suspend your access to the site and if payment is not made 30 days following such second reminder, your account will be cancelled. If you subsequently want to use the Internet Diary, you will need to apply for a new account.
- Unlawful or prohibited use
The technical staff at Diary UK Ltd will, from time to time, need to reset the servers or upgrade various software components that enable the efficient working of the website. Although efforts will be made to minimise the effect on users, Diary UK Ltd shall not be liable to any person for any loss or damage incurred by such downtimes.
- Outgoing Email & SMS Messages
All outgoing Email and SMS Messages will have a Diary UK Ltd signature appended to them which will inform the recipient of the message that the message was sent using www.internetdiary.net.
Diary UK Limited is listed in Information Commissioner’s Office Register of Data Controllers Registration Number Z9006194. The lawful bases for processing personal data as set out in Article 6 of GDPR are:
(a) Consent: You have given clear consent for Diary UK Ltd to process your personal data for a specific purpose.
(b) Contract: the processing is necessary for a contract Diary UK Ltd have with you to provide services and to administer your account.

• Entries you make to your diary will also be encrypted before saving to the database.
• You must have authority to disclose any personal information about others that you enter into your diary, or in any message to Diary UK Ltd. You are responsible for the accuracy and relevance of that information.
• Diary UK Ltd will not share your personal information with other organisations without your explicit consent, unless we are obliged or permitted by law to disclose it.
• Personal information will be shared with Worldpay to process subscription payments, when you have consented to this. Worldpay may transmit personal information to others (eg your card provider) to process payments.
- Cancellations A customer can cancel their account with Diary UK Ltd at any time by logging in to worldPay (instructions for this can be found in Frequently Asked Questions) or by emailing firstname.lastname@example.org with a request to cancel.
- Price Changes
Diary UK reserves the right, at its sole discretion, to amend the subscription cost of its service and the unit cost of SMS text messages or facsimile messages, depending on market conditions. Customers will be informed by e-mail at least 7 days in advance of any change.
- Refunds and disputed transactions
If you are not satisfied with the internetDiary service you should stop using the service immediately and write to us at email@example.com within 7 days of making payment. We will issue a full refund to the same debit or credit card you used to make the payment. Exclusions: excludes the cost of any text messages or faxes you have sent at the current rate published elsewhere on this website. This does not affect your statutory rights.
- Changes to Legal Notices
We reserve the right to change these Terms and Conditions from time to time.
This website, any content contained herein and any contract brought into being as a result of usage of this website are governed by and construed in accordance with the law of England and Wales. The parties to any such contract agree to submit to the exclusive jurisdiction of the courts of England and Wales. If any of these terms and conditions should be determined to be illegal, invalid or unenforceable such term or condition shall to the extent required be severed from these terms and conditions and rendered ineffective, as far as possible without modifying the remaining provisions of these terms and conditions.

You may find that the site will work equally well in a range of browsers subject to minor changes in appearance, however Diary UK Ltd give no such undertaking. Future developments may improve the compatibility of the site with a wider range of browsers and screen resolutions.
